County Clerk Requests Declaratory Judgment Relief in Shady Cove Water District Dispute
The Jackson County Clerk has requested declaratory judgment relief from the Jackson County Circuit Court in an attempt to put an end to an ongoing legal dispute between Jim Collier and the Shady Cove Water District regarding the anticipated election on dissolution of the Shady Cove Water District. Mr. Collier claims the Shady Cove Water District owes him approximately $17,000 and that the Shady Cove Water District must agree to pay that amount before the election will be valid.
Voter consideration of the Shady Cove Water District’s Plan of Dissolution and Reorganization was tentatively slated for the March election, but the Jackson County Circuit Court has agreed to enter a temporary injunction to allow postponement of the election.
“This will allow time for the Court to resolve the ongoing dispute between Mr. Collier and the Shady Cove Water District before incurring the cost of the election,” said Jackson County Clerk Chris Walker.
